Terms of Service
Welcome to AegisRealtor.com (the “Site”), operated by Aegis Real Estate & Investments, Inc., a California corporation, California Department of Real Estate Broker License Number 01100487 (“Aegis,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site and any related services we provide through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under California law to use this Site. By using the Site, you represent and warrant that you meet these requirements.
2. Nature of the Site — No Brokerage Relationship Created
The Site provides general information about Aegis and California real estate. Visiting the Site, submitting an inquiry, requesting a consultation, or otherwise communicating with us through the Site does not, by itself, create an agency, fiduciary, broker-client, or other professional relationship between you and Aegis. A formal real estate brokerage, representation, or advisory relationship is established only upon the execution of a separate written agreement signed by both you and an authorized representative of Aegis (such as a residential listing agreement, buyer representation agreement, or commercial engagement letter), as required by California law.
3. License Disclosure & Equal Housing Opportunity
Aegis Real Estate & Investments, Inc. is a licensed California real estate broker. Broker license number: 01100487. The principal broker is Gary Gadd. License status may be verified at the California Department of Real Estate at dre.ca.gov.
Aegis is committed to and complies with all federal, state, and local fair housing laws, including the federal Fair Housing Act, the California Fair Employment and Housing Act, and the Unruh Civil Rights Act. 4. Property Listings & Information Disclaimer
Property descriptions, photographs, prices, square footages, school assignments, tax data, and other property information displayed on the Site are provided for general informational purposes and may be obtained from the seller, the multiple listing service (MLS), public records, or other third-party sources. Aegis does not independently verify all such information and makes no representation or warranty regarding its accuracy, completeness, or current availability. You should independently verify all information that is material to a purchase, sale, lease, or investment decision before acting upon it. Listings may be withdrawn, modified, or sold at any time without notice. Square footage figures are approximate and not warranted.
5. No Professional Advice
Content on the Site, including blog posts, market commentary, mortgage calculators, and FAQs, is provided for general informational purposes only and is not legal, tax, financial, accounting, lending, appraisal, inspection, or investment advice. You should consult with appropriately licensed professionals (attorney, CPA, mortgage professional, financial advisor, certified inspector, certified appraiser, etc.) before making any decision based on Site content. Mortgage calculators and similar tools provide estimates only and do not constitute a quote, pre-approval, or commitment to lend.
6. User Submissions & Communications
When you submit a contact form, request a consultation, subscribe to communications, or otherwise provide information to us through the Site, you agree that:
- The information you provide is accurate and complete to the best of your knowledge;
- You consent to be contacted by Aegis at the email address, postal address, and telephone number(s) you provide, including by autodialed or prerecorded calls and text messages where permitted, in accordance with our Privacy Policy and SMS & Messaging Policy;
- You will not transmit content that is unlawful, defamatory, harassing, threatening, infringing, or otherwise objectionable;
- You grant Aegis a limited, non-exclusive license to use the information you submit for the purpose of responding to your inquiry and providing services.
7. Prohibited Conduct
You agree not to:
- Use the Site in any manner that violates any applicable federal, state, or local law (including California law) or regulation;
- Scrape, crawl, harvest, mirror, or otherwise systematically extract listing data, photographs, or other content except as expressly permitted by us in writing;
- Use bots, automated agents, or similar tools to access the Site for purposes other than indexing by major search engines in accordance with the Site’s
robots.txt; - Attempt to interfere with, compromise, probe, or disable the Site, its hosting infrastructure, or its security mechanisms;
- Reverse engineer, decompile, or extract source code from the Site;
- Use the Site to transmit unsolicited commercial communications, malware, or other harmful code;
- Misrepresent your identity or affiliation, or use the Site for unauthorized commercial solicitation of Aegis clients.
8. Intellectual Property
All content on the Site — including the “Aegis” name and logo, page layouts, photographs, illustrations, graphics, text, and software — is owned by or licensed to Aegis and is protected by United States and international copyright, trademark, and other intellectual property laws. Except for limited personal, non-commercial viewing, you may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written permission. The MLS, where applicable, retains all rights in MLS-sourced data.
9. Third-Party Links and Services
The Site may contain links to third-party websites or services (e.g., Zillow, Yelp, Facebook, mapping services, mortgage lender sites). Aegis does not control these third parties and is not responsible for their content, privacy practices, or terms. Your use of any third-party site is governed by that site’s own terms and policies.
10. Disclaimers of Warranty
THE SITE AND ALL CONTENT, FUNCTIONALITY, AND INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AEGIS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AEGIS, ITS OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF AEGIS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, AEGIS’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).
Some jurisdictions, including California to a limited extent, do not allow the exclusion of certain warranties or limitation of certain damages; the above limitations apply only to the extent permitted by law and do not limit any non-waivable rights you may have under California law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Aegis and its officers, directors, agents, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; or (c) your violation of any law or the rights of a third party.
13. Communications and California Recording Notice
By contacting Aegis or providing your contact information, you consent to receive responsive communications from us by phone, email, postal mail, and (where you have specifically opted in) text message. California is a two-party consent state under California Penal Code §§ 631 and 632. We will obtain your consent before recording any telephone call, and we will not record calls with you without first notifying you. For details on text messaging, see our SMS & Messaging Policy. 14. Modifications to the Site or These Terms
We reserve the right to modify, suspend, or discontinue any portion of the Site at any time without notice. We may revise these Terms from time to time; the revised Terms will be effective when posted, with the new effective date shown above. Material changes will be highlighted on this page. Your continued use of the Site after the revised Terms are posted constitutes your acceptance of the revised Terms.
15. Governing Law & Venue
These Terms and any dispute arising out of or relating to these Terms or your use of the Site are governed by the laws of the State of California, without regard to its conflict of laws principles. The exclusive venue for any state or federal court action arising out of or relating to these Terms shall be the state and federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.
16. Severability & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and SMS Policy, constitute the entire agreement between you and Aegis regarding the Site and supersede all prior agreements regarding the same subject matter, but do not supersede any signed brokerage, listing, representation, or engagement agreement, which controls in the event of any conflict regarding the brokerage relationship described in that agreement.
