Privacy Policy
This Privacy Policy describes how Aegis Real Estate & Investments, Inc. (“Aegis,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information from visitors to AegisRealtor.com (the “Site”) and prospective and current clients of our California real estate brokerage services (collectively, “you”). It also describes the rights California residents have under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (together, the “CCPA”).
1. Scope
This Privacy Policy applies to personal information we collect through the Site, by phone, by email, by text message (subject to our SMS & Messaging Policy), in person, or in connection with a real estate transaction or advisory engagement. 3. Sources of Personal Information
We collect personal information directly from you (forms, email, phone, in-person meetings), automatically when you use the Site (cookies, server logs, analytics), and from third parties when relevant to a transaction (the MLS, public records, title and escrow companies, lenders you select, prior agents). We will tell you the source on request as required by the CCPA.
4. How We Use Personal Information
We use personal information for the following business and commercial purposes:
- To respond to your inquiries and provide real estate brokerage and advisory services;
- To match you with properties, listings, or investment opportunities relevant to your stated interests;
- To facilitate transactions, including with title, escrow, lender, inspection, and appraisal vendors you authorize;
- To send service-related communications, market updates, and (where you have separately opted in) marketing communications by email or text message;
- To comply with legal obligations (real estate licensure rules, fair housing, anti-money laundering, tax reporting, court orders, subpoenas);
- To detect, prevent, and respond to fraud, security incidents, and abuse;
- To improve and secure the Site, our services, and our internal operations;
- To exercise or defend legal claims.
We do not use sensitive personal information for purposes other than those permitted under the CCPA without first obtaining your consent.
5. How We Share Personal Information
We share personal information only as needed to provide our services, comply with the law, or protect rights and safety. Categories of recipients include:
- Service providers bound by contract to use information only for our purposes (e.g., website hosting, email delivery, SMS/CRM platforms, analytics, document management, e-signature services, accounting).
- Transaction parties where you authorize us to share information for a real estate transaction (e.g., title and escrow companies, lenders, attorneys, inspectors, appraisers, the MLS, the buyer or seller’s agent on the other side of a transaction).
- Government authorities when required by law, regulation, court order, subpoena, or valid governmental request, or to protect our rights, property, or safety or that of others.
- Successors in the event of a merger, acquisition, financing, reorganization, or sale of assets, in which case we will require the successor to honor this Policy.
6. “Sale” and “Sharing” of Personal Information
We do not sell your personal information for money, and we do not share your personal information for cross-context behavioral advertising, as those terms are defined in the CCPA. We have not done so in the preceding 12 months. If this changes, we will update this Policy and provide a “Do Not Sell or Share My Personal Information” mechanism as required by California law.
7. Retention
We retain personal information only as long as necessary to fulfill the purposes for which it was collected, to comply with our legal, regulatory, tax, accounting, or audit obligations, and to resolve disputes or enforce agreements. Real estate transaction records are retained for the period required under California Department of Real Estate rules (currently three years from the close of the transaction or listing termination, with longer periods for certain trust account records and disclosures).
8. Your California Privacy Rights
If you are a California resident, you have the following rights under the CCPA:
- Right to Know — the categories of personal information we have collected, the sources, the purposes, the categories of recipients, and (upon a verifiable request) the specific pieces of personal information we hold about you.
- Right to Delete — subject to legal exceptions (e.g., we must keep transaction records to comply with DRE rules and tax law).
- Right to Correct inaccurate personal information.
- Right to Limit Use of Sensitive Personal Information — we use sensitive personal information only as permitted by the CCPA, but you may direct us to limit further use.
- Right to Opt Out of Sale/Sharing — we do not sell or share, but you may submit a request to confirm.
- Right to Non-Discrimination — we will not discriminate against you for exercising your rights.
- Right to Portability — you may request a portable copy of personal information you have provided to us.
- Authorized Agent — you may use an authorized agent to make a request on your behalf, with written permission and proof of identity.
9. How to Exercise Your Rights
To submit a verifiable consumer request, contact us using the information in Section 15 below or call (714) 590-9977. We will:
- Acknowledge receipt within 10 business days;
- Verify your identity (typically by matching at least two pieces of information you have previously provided, or via a signed declaration under penalty of perjury for sensitive requests);
- Respond substantively within 45 days (extendable once by 45 days with notice).
We do not require you to create an account to submit a request. There is no fee unless your request is manifestly unfounded or excessive. If we deny your request, we will explain why and how to appeal.
10. Cookies and Online Tracking
The Site uses a small number of cookies and similar technologies to remember your preferences, measure traffic, and improve performance. We may use first-party analytics (such as Google Analytics) configured to mask IP addresses where supported. You can control cookies through your browser settings. We honor the Global Privacy Control (GPC) signal as a valid opt-out of sale/sharing for browsers transmitting it; because we do not sell or share, GPC simply confirms your preferences are already respected. We do not respond to legacy “Do Not Track” browser headers because there is no industry consensus on their meaning.
11. California Shine the Light
California Civil Code § 1798.83 permits California residents to request a notice describing categories of personal information we shared with third parties for those parties’ direct marketing purposes. We do not share personal information for third-party direct marketing purposes. Requests under Shine the Light may be sent to the contact information in Section 15 with the subject line “Shine the Light Request.”
12. Children’s Privacy
The Site is not directed to children under 16. We do not knowingly collect personal information from children under 16. If we learn we have done so, we will delete that information. We do not sell or share the personal information of consumers under 16 without an opt-in as required by the CCPA.
13. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. No method of electronic transmission or storage is 100% secure. If a security incident occurs that materially affects your personal information, we will notify you as required by California Civil Code § 1798.82.
14. Changes to This Policy
We may update this Privacy Policy to reflect changes in our practices or in applicable law. The “Last Updated” date above will reflect the date of the most recent revision. Material changes will be highlighted at the top of this page for at least 30 days.
